Welcome to Gaye Lightbody Art. These Terms & Conditions apply to purchases made through this website, including original paintings, limited-edition prints, gift items and commissioned or bespoke artwork.

By placing an order through this website, you agree to these Terms & Conditions.

1. About Me

This website is operated by Gaye Lightbody, trading as Gaye Lightbody Art.

I am an independent artist based in Northern Ireland.

2. Artwork & Product Information

Each artwork is an original piece created by me unless otherwise stated.

I make every effort to ensure that photographs, colours, dimensions and descriptions on this website accurately represent the artwork. However, colours may vary slightly between different screens and devices.

Original paintings are individually created works and may contain natural variations in texture, brushwork, paint application, metallic leaf, varnish and other materials. These characteristics are part of the nature of original artwork and are not considered defects.

Dimensions stated on product listings refer to the artwork itself unless otherwise specified. Where an artwork is framed, the listing will state whether the dimensions refer to the framed or unframed artwork.

3. Prices

All prices are shown in pounds sterling (£), unless otherwise stated.

The price displayed at checkout is the price payable for the artwork, together with any applicable delivery charges.

I reserve the right to change prices at any time. However, once an order has been accepted and payment received, the price applicable to that order will not be changed, unless there are exceptions regarding additional postages costs.

Gaye Lightbody Art is currently not VAT registered. No VAT is therefore added to the prices displayed.

4. Placing an Order

When you place an order through the website, you are making an offer to purchase the artwork selected.

Your order will be confirmed by email once payment has been successfully received.

I reserve the right to decline or cancel an order in exceptional circumstances, for example if an artwork has been incorrectly listed as available, has already been sold, or there is an obvious pricing or technical error.

If I need to cancel an order, you will receive a full refund of any amount you have paid.

5. Payment

Payment is made securely through the payment methods offered at checkout.

I do not have access to or store your full payment card details.

Your order will normally be processed once payment has been successfully authorised.

6. Shipping & Delivery

Shipping costs are calculated automatically at checkout based on your delivery address and the size and nature of your order.

I take care to package artwork securely and appropriately for its size, value and destination.

Estimated delivery times will be provided where possible. Delivery times are estimates rather than guaranteed dates and may be affected by courier delays, weather, customs procedures or other circumstances outside my control.

For larger original artworks, specialist or insured delivery may be required. If this applies, I will contact you before dispatch if an additional arrangement or charge is necessary.

Unless otherwise agreed, artwork will be delivered to the address provided when the order is placed.

7. Delivery Damage

I take great care when packaging artwork, but unfortunately damage can occasionally occur during transit.

Please inspect your package as soon as possible after delivery.

If your artwork arrives damaged, please contact me as soon as reasonably possible and provide:

  • photographs of the external packaging;
  • photographs of the internal packaging; and
  • clear photographs of the damaged artwork.

Please retain the original packaging until the matter has been resolved, as the courier may require it for an insurance claim.

I will work with you to resolve the problem and, where appropriate, arrange a repair, replacement or refund in accordance with your statutory rights.

Nothing in these Terms & Conditions affects your legal rights if goods are faulty, damaged or not as described.

8. International Orders & Customs

I may offer delivery to destinations outside the UK. Available destinations and delivery charges will be shown at checkout.

For international orders, the customer is responsible for checking whether the artwork can be legally imported into their country and whether any customs requirements apply.

Any customs duties, import taxes, brokerage charges or other fees imposed by the destination country or its customs authorities are the responsibility of the customer unless expressly stated otherwise at checkout.

These charges are not included in the artwork price or standard shipping charge unless specifically stated.

Please be aware that customs procedures can sometimes delay delivery.

For information about exporting goods from the UK, customers can check the relevant requirements for their destination country.

9. Returns & Your Right to Cancel

I want you to be happy with your purchase.

For standard artwork purchased online, consumers generally have a statutory right to cancel a distance purchase within 14 days of receiving the goods, without having to give a reason.

If you wish to cancel an order under this right, please contact me by email within 14 days of receiving your artwork.

After notifying me of your cancellation, you should return the artwork within 14 days.

The artwork should be returned in its original condition and packaged securely.

Unless the artwork is faulty, damaged or not as described, you are responsible for the direct cost of returning an unwanted artwork.

I recommend using a tracked and insured delivery service when returning original artwork.

I may delay your refund until the artwork has been returned or you provide evidence that it has been returned, whichever happens first.

Where you have exercised your statutory right to cancel, I will refund the purchase price and the standard delivery charge paid for the original order, subject to the applicable consumer-law rules.

If you selected a more expensive delivery option than the standard delivery option offered, the additional cost may not be refundable.

Nothing in this section affects your statutory rights.

10. Artwork Returned in Reduced Condition

You are entitled to handle an artwork to the extent reasonably necessary to establish its nature, characteristics and functionality.

However, if an artwork is returned with damage, marks or deterioration resulting from handling beyond what would reasonably be permitted in a shop, I may be entitled to make a deduction from the refund to reflect the resulting reduction in value, where permitted by law.

This does not affect your statutory rights.

11. Faulty, Damaged or Misdescribed Artwork

Your statutory consumer rights apply in addition to this returns policy.

If an artwork is faulty, damaged in transit, materially different from its description, or otherwise does not meet the requirements of consumer law, please contact me as soon as possible.

Depending on the circumstances and your legal rights, you may be entitled to a repair, replacement, price reduction or refund.

I will always try to resolve problems fairly and promptly.

12. Order Cancellations Before Dispatch

If you change your mind about an order, please contact me as soon as possible.

If your artwork has not yet been dispatched, I will normally be able to cancel the order and provide a refund.

If the artwork has already been dispatched, the normal returns and cancellation procedure will apply.

13. Limited-Edition Prints

Where a print is described as a limited edition, the edition size stated on the product listing represents the maximum number of prints intended to be produced in that edition.

Each limited-edition print may be individually numbered and, where stated, signed by the artist.

The edition number does not refer to the number of artworks sold but to the total edition planned for that particular artwork, size and/or format.

Different sizes or formats may constitute separate editions where this is stated in the product description.

14. Certificates of Authenticity

Where a Certificate of Authenticity is supplied, it confirms the identity and authenticity of the artwork as an original work or limited-edition print by Gaye Lightbody.

For original paintings, the certificate may include details such as the artwork title, dimensions, medium, date of creation and unique identification or reference number.

For limited-edition prints, the certificate may include the edition number and total edition size.

A Certificate of Authenticity does not transfer copyright or any intellectual-property rights to the purchaser.

15. Framing

Where an artwork is sold framed, the frame forms part of the product as described in the individual listing.

Frames are selected to complement the artwork and may be made from natural or manufactured materials. Small variations in wood grain, finish or appearance may occur.

Unless otherwise stated, framed artwork is supplied ready to hang.

If an artwork is sold unframed, the customer is responsible for arranging their own framing.

16. Commissioned & Bespoke Artwork

I also accept commissions from time to time, subject to availability.

Before a commission is accepted, I will agree with you:

  • the subject and general concept;
  • approximate dimensions;
  • medium and materials;
  • colour palette or other agreed characteristics;
  • price;
  • payment arrangements; and
  • estimated completion timeframe.

A commission is not confirmed until the agreed arrangements and any required deposit or payment have been received.

Because commissioned artwork is created specifically for an individual customer, it may be treated differently from standard artwork available for general sale.

Once work has commenced, cancellation by the customer may result in a charge reflecting work already undertaken and reasonable costs incurred.

Where a commission is genuinely made to the customer's specifications or personalised for them, statutory cancellation rights may not apply in the same way as they do to standard artwork.

Any cancellation charges will be fair and proportionate to work undertaken and costs incurred.

I will provide further commission-specific terms before work begins where appropriate.

17. Commission Approvals & Changes

I may provide photographs, sketches or other progress information during a commission.

Where the agreed commission includes an approval stage, the customer will have the opportunity to provide feedback within the agreed timeframe.

Changes requested after work has substantially progressed may incur additional costs or affect the completion date.

I reserve the right to decline changes that would fundamentally alter the original agreed commission.

The final artwork will be an original handmade work and may contain variations in texture, brushwork, colour and finish that are inherent in the creative process.

18. Copyright & Intellectual Property

All artwork displayed on this website, including original paintings, prints, photographs, website images, written descriptions, logos and other creative content, remains the intellectual property of Gaye Lightbody Art and/or the relevant copyright owner unless expressly stated otherwise.

Copyright in an original artwork remains with the artist even after the physical artwork has been sold.

Purchasing an original painting or print does not transfer copyright to the purchaser.

You may display artwork that you have legitimately purchased for personal use.

You may not, without my prior written permission:

  • reproduce, copy or scan an artwork;
  • create prints or other reproductions;
  • use an artwork for commercial purposes;
  • reproduce an artwork on merchandise;
  • alter or digitally manipulate an artwork for commercial use;
  • claim authorship of the artwork; or
  • reproduce images from this website for commercial purposes.

Copyright in original artistic works is protected under UK copyright law.

19. Photography & Images

All photographs and digital images of my artwork are protected by copyright unless otherwise stated.

You may not download, reproduce or use images from this website for commercial purposes without prior written permission.

If you are a customer who has purchased an artwork and would like to share a photograph of it on social media, you are welcome to do so for personal, non-commercial purposes. Credit to Gaye Lightbody Art is appreciated.

20. Artist's Rights

The purchase of an artwork does not prevent me from continuing to use photographs of the artwork for my portfolio, website, exhibitions, social media, publicity and promotional purposes, unless otherwise agreed with the customer.

For commissioned artwork, any specific confidentiality or usage arrangements will be agreed separately where required.

21. Website Content

I make reasonable efforts to ensure that information on this website is accurate and up to date.

However, occasional errors, omissions or technical issues may occur.

I reserve the right to correct errors, update information and amend product availability or descriptions where necessary.

Nothing in these Terms & Conditions limits your statutory rights as a consumer.

22. Privacy & Personal Information

When you place an order, I collect and use personal information necessary to process and fulfil your purchase.

This may include your name, billing address, delivery address, email address, telephone number and order information.

Your information may be shared with trusted third parties where necessary to process your order, for example:

  • payment providers;
  • Shopify and related ecommerce services;
  • delivery companies and couriers;
  • printing or fulfilment providers where applicable; and
  • professional or legal advisers where necessary.

I do not sell your personal information.

Personal information will be retained only for as long as reasonably necessary for the purposes for which it was collected, including fulfilling orders, maintaining business and tax records, dealing with disputes and meeting legal obligations.

Where I send marketing communications, I will do so in accordance with applicable data-protection and electronic-marketing laws.

You may unsubscribe from marketing communications at any time.

23. Cookies

This website may use cookies and similar technologies to provide essential website functionality, remember shopping-cart information, improve the website and, where applicable, understand how visitors use the website.

Where required, non-essential cookies and similar technologies will only be used with the appropriate consent.

24. Complaints

If you have a problem with an order, artwork or service, please contact me first at:

Please provide your order number and a description of the issue where possible.

I will aim to acknowledge complaints promptly and work with you to reach a fair resolution.

25. Events Outside My Control

I will not be responsible for delays or failure to perform obligations caused by circumstances reasonably beyond my control, including severe weather, natural disasters, industrial action, courier disruption, customs delays, government restrictions, interruption to essential services or other exceptional events.

Where such circumstances occur, I will communicate with you and take reasonable steps to minimise any resulting delay.

26. Limitation of Liability

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, or your statutory consumer rights.

Subject to this, I will not be liable for indirect or consequential losses that are not reasonably foreseeable.

Nothing in these Terms & Conditions affects your legal rights as a consumer.

27. Changes to These Terms

I may update these Terms & Conditions from time to time to reflect changes to my business, website or applicable legal requirements.

The Terms & Conditions applying to an order will be those in force at the time the order is placed.

28. Governing Law

These Terms & Conditions are governed by the laws applicable in Northern Ireland.

Any dispute will be subject to the jurisdiction of the courts of Northern Ireland, subject to any mandatory consumer rights that may apply.
